Hood Meadows 2022-23 Lesson and Rental Liability Release The purchaser, holder and/or user of this rental equipment and/or ski school lesson (“Participant”) understands that skiing, snowboarding and other winter activities (“Skiing”) can be HAZARDOUS and that injuries are common when participating in such activities. Participant accepts and assumes the risks associated with Skiing, including, but not limited to, changing weather conditions, variations and steepness in terrain, terrain features and parks, snow or ice conditions, surface or subsurface conditions, bare spots, creeks and gullies, forest growth, avalanches, snow immersion, rocks, stumps, the use of lifts, collisions with natural or man-made objects or other persons, grooming and snowmobile equipment, lift towers and other structures and their components, falling, loss of control, exceeding one’s ability, and exceeding the limits of equipment to protect from injury or death. Participant hereby freely and expressly ASSUMES ANY AND ALL RISK OF INJURY, DEATH AND PROPERTY DAMAGE death associated with Skiing. Participant understands that the ski/boot/binding system rented will not release or retain at all times nor under all circumstances where release or retention may prevent injury, nor is it possible to predict every situation in which it will release or retain, and it is therefore not a guarantee of safety. Participant understands that snowboard boot/ bindings systems are not designed or intended to release and are not a safety device. Participant also understands that helmets are not designed to prevent injury under all circumstances and that the use of a helmet is no guarantee of safety. IN CONSIDERATION FOR USE OF THIS RENTAL EQUIPMENT AND THE USE OF ANY OTHER AREA FACILITIES, SERVICES AND PREMISES, PARTICIPANT HERE BY AGREES TO RELEASE, HOLD HARMLESS, AND INDEMNIFY MT. HOOD MEADOWS OREG., LLC AND ITS OWNERS, PARTNERS, EMPLOYEES, DIRECTORS, AGENTS, AFFILIATES AND RELATED ENTITIES (“MEADOWS”), AND ALL MANUFACTURERS AND DISTRIBUTORS OF THE EQUIPMENT PROVIDED OR SERVICED UNDER THIS AGREEMENT (“MANUFACTURERS AND DISTRIBUTORS”), FROM ANY AND ALL CLAIMS AGAINST THEM ARISING DIRECTLY OR INDIRECTLY OUT OF ANY USE OF THIS EQUIPMENT AND/ OR THE AREA FACILITIES, SERVICES AND PREMISES. THIS RELEASE ONLY INCLUDES CLAIMS AND LIABILITIES ARISING FROM ORDINARY NEGLIGENCE ON THE PART OF MEADOWS AND/OR MANUFACTURERS AND DISTRIBUTORS. PARTICIPANT ALSO AGREES TO INDEMNIFY (INCLUDING COSTS AND ATTORNEY FEES) MEADOWS, MANUFACTURERS AND DISTRIBUTORS FOR ANY CLAIM BROUGHT ON BEHALF OF A MINOR NAMED ON THIS GROUP CONSENT FORM. Participant accepts the equipment without any warranties, express or implied, other than those made in this document. Participant will be responsible for the replacement, at full retail value, of any equipment rented from Meadows for any loss or damage of any kind which results from the use of this equipment and accepts full responsibility for its care while it is in the Participants possession. Participant agrees to return all equipment by the agreed date in clean condition, to avoid any additional charges. Participant had made no misrepresentations to Meadows about height, weight, age or skiing/snowboarding ability of the Participant named on this Group Consent Form and Participant agrees to verify that release/retention or stance settings on rental equipment correspond to those stated on the Rental Release Agreement. INJURIES may result as a consequence of participation in a ski school class. The Participant therefore assumes the responsibility of skiing under control at all times and is the sole judge of their ability to ski any terrain or perform any maneuver whether or not directed by a representative of the Mt. Hood Meadows Ski School. If I am signing on behalf of a minor, I accept full responsibility for all medical expenses incurred as a result of the minor’s participation in Mt. Hood Meadows class. I also understand that ski school students of any age, in some cases, may be asked to board the chair lift alone or with another person and may not always ride with an instructor.
